Terms & Conditions

Last updated 27 September 2026

1. Who we are

Beyond Blue Digital, referred to as we, us or the Studio, is a web design and digital marketing studio operating in South Africa. Full registration details and registered address are available on request.

2. When these terms apply

These terms apply to every quote, proposal and project we take on, unless we have signed a separate written agreement with you that says otherwise. By accepting a quote, paying a deposit, or asking us to begin work, you accept these terms.

3. Quotes and scope

Quotes are valid for 30 days and are based on the scope described in them. Page counts, feature lists and revision rounds stated in a quote are the agreed scope. Anything outside that scope is additional work, and we quote it separately before starting it.

4. Payment

Once-off build fees: 50% deposit before work begins, the balance due on completion and before the site goes live.
Monthly hosting, domain and care fees are billed monthly in advance.
Invoices are payable within 7 days of date of issue.
We may pause work or suspend services on an overdue account after giving you written notice.
Overdue amounts may attract interest at the rate prescribed under the Prescribed Rate of Interest Act.

5. Cancellation

Set out in full in our Cancellation and Refund Policy. In short: the deposit is not refundable, and once a build has commenced the full project fee becomes due and payable.

6. What we need from you

Our timelines assume you supply content, images, logins and feedback when we ask for them. If we are waiting on you for more than 14 days we may pause the project, reschedule it into the next available slot, and invoice for the work completed to that point.

7. Timelines

Timelines are estimates given in good faith, not guarantees. Delays caused by you, by third parties, or by events outside our reasonable control extend them accordingly.

8. Revisions

Your quote includes the revision rounds stated in it. Further rounds, and changes of direction after a stage has been signed off, are billed at our then-current hourly rate.

9. Third-party services

Some work depends on third parties, including domain registrars, hosting infrastructure, payment gateways, plugins, and social and advertising platforms. We are not responsible for their outages, price increases, policy changes or discontinuation, and we are not liable for loss arising from them.

10. Ownership and intellectual property

On receipt of full payment, ownership of the final website design and of the content we produced specifically for you passes to you. Until we have been paid in full, everything we produce remains our property.

We keep ownership of our own tools, code libraries, frameworks, templates and pre-existing materials, and the right to reuse them on other projects. Third-party assets such as fonts, stock imagery and plugins remain the property of their owners and are licensed to you, not sold.

You warrant that any material you supply to us is yours to use, and you indemnify us against any claim that it is not.

11. Portfolio

Unless you tell us otherwise in writing, we may show the work in our portfolio, on this website and on social media.

12. Hosting and domains

Hosting and domain services are governed by these terms together with our Acceptable Use Policy. We aim for high availability but do not guarantee uninterrupted, error-free service. We keep routine backups, but you remain responsible for keeping your own copies of anything critical.

13. Confidentiality

Each of us will keep the other’s non-public business information confidential, and will use it only for the purpose of the project.

14. Limitation of liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental or consequential loss, including lost profits, lost revenue, lost data, or loss of business opportunity.
Our total liability arising out of or in connection with any project is limited to the fees you actually paid us for that project in the three months preceding the claim.
Nothing here excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008.

15. Indemnity

You indemnify us against claims, losses and costs arising from your content, your products or services, or your use of the website after handover.

16. Governing law

These terms are governed by the laws of the Republic of South Africa, and both parties consent to the jurisdiction of the South African courts.

17. Changes to these terms

We may update these terms from time to time. The version published on this website at the time you accept a quote is the version that governs that project.

Privacy Policy

Last updated 27 September 2026

This policy explains how Beyond Blue Digital collects and uses personal information, in line with the Protection of Personal Information Act 4 of 2013, known as POPIA.

1. Who is responsible

Beyond Blue Digital is the responsible party for the personal information described here. You can reach our Information Officer at contact@beyondbluedigital.com.

2. What we collect

What you give us: your name, business name, email address, phone number, and anything else you put into an enquiry form, an email or a WhatsApp message.
What is collected automatically: IP address, browser and device type, pages viewed, referring website, and similar technical data.
Project information: logins and credentials you share so we can do the work, and your billing details.

3. Why we use it

To answer your enquiry and prepare a quote.
To carry out the work you have engaged us for.
To invoice you and keep proper accounting records.
To maintain, secure and back up websites we host.
To send you service messages about your website or account.
To understand and improve this website.

We rely, as applicable, on your consent, on performing a contract with you, on our legitimate interests, and on our legal obligations.

4. Marketing

We only send marketing email if you asked for it or are an existing client. Every marketing message carries an unsubscribe link, and we act on unsubscribes promptly.

5. Cookies

This website uses cookies that are necessary for it to function, and may use analytics cookies to understand how the site is used. You can block or delete cookies in your browser settings. Some parts of the site may then not work as intended.

6. Who we share it with

We share personal information only with the service providers who help us operate, such as hosting providers, email providers, analytics providers, payment processors and our accountants, and only as far as they need it to do their job. We do not sell your personal information.

7. Where it is stored

Information may be stored or processed on servers outside South Africa. Where that happens, we take reasonable steps to make sure it is protected on a standard comparable to POPIA.

8. How long we keep it

For as long as it is needed for the purpose it was collected, and after that for as long as the law requires us to keep records.

9. Security

We take reasonable technical and organisational steps to protect personal information. No system is completely secure, and we cannot guarantee absolute security.

10. Your rights

Under POPIA you may ask what personal information we hold about you, ask us to correct or delete it, object to processing, and withdraw consent where we relied on it. Write to us at the address above and we will respond within a reasonable time.

11. Complaints

If you are not satisfied with how we have handled your information, you may lodge a complaint with the Information Regulator of South Africa.

12. Changes

We may update this policy. The version published here is always the current one.

Cancellation & Refunds

Last updated 27 September 2026

This policy forms part of our Terms and Conditions. Please read it before you accept a quote.

1. Deposits

The deposit on a once-off build is not refundable. It reserves your place in our production schedule and covers the discovery, planning and design work that starts immediately on acceptance.

2. Cancelling a build

Once a build has commenced, the full project fee becomes due and payable, whether or not the project reaches completion, and whether the cancellation is made by you or is caused by you failing to supply content, feedback or approvals.

A build is commenced as soon as we begin any work on it, including discovery, planning, copywriting, design or development. If you cancel before any work has commenced, you forfeit the deposit and nothing further is payable.

Why this clause exists. A build books out a block of our production schedule that we turn other work away to protect. When a project is cancelled part-way, that time cannot be resold at short notice.

3. Monthly hosting, domain and care

Monthly services run month to month. To cancel, give us written notice of at least one calendar month. The month in progress is not refunded, and monthly fees already paid are not refunded.

4. Domains

Domain registrations and renewals are paid across to third-party registrars and are never refundable. On cancellation we will transfer a domain registered in your name to you or to another provider, once your account is settled in full.

5. Handover on cancellation

Once your account is settled in full, we will hand over the website files, the domain and the content. We are not obliged to hand over anything while an amount remains outstanding.

6. Cancellation by us

We may cancel a project or suspend services if an invoice is more than 30 days overdue, if you breach these terms or the Acceptable Use Policy, or if the working relationship has broken down. Fees for work completed up to that point remain payable.

7. Your rights under the Consumer Protection Act

Nothing in this policy limits any right you have under the Consumer Protection Act 68 of 2008 where that Act applies to you. Where it applies, any cancellation charge will be limited to a reasonable cancellation penalty as contemplated in that Act.

Acceptable Use

Last updated 27 September 2026

This policy applies to every website we host and to every service we provide.

1. What you may not do

Anything unlawful under South African law.
Publish content that infringes someone else’s copyright, trade mark or other rights.
Host or distribute malware, run phishing pages, or attempt to gain unauthorised access to any system.
Send bulk unsolicited email from, or advertising, a site we host.
Publish content that is defamatory or harassing, or that promotes hatred or violence.
Publish any content prohibited by law, including sexual material involving minors.

2. Resource use

Hosting is sized for normal business website use. If a site consistently uses resources well beyond that, we will contact you to discuss moving to a larger plan rather than simply switching it off.

3. Your content

You are responsible for everything published on your website, including content added by your staff and content submitted by visitors. You warrant that you have the right to publish it.

4. Backups

We keep routine backups as part of the care plan. They are a convenience, not a guarantee. Keep your own copies of anything you cannot afford to lose.

5. Suspension

We may suspend or remove content or a website that breaches this policy. Where a breach is serious or unlawful we may act without prior notice, and we will tell you as soon as we reasonably can.

6. Reporting abuse

Report anything you believe breaches this policy to contact@beyondbluedigital.com.
